Job Profile
The primary responsibility of the Associate Director Legal and Compliance DACH is to support Germany, Switzerland and Austria in any legal, Compliance and data privacy aspects under the leadership of the VP, Head of Legal & Compliance Europe and Canada with a dotted line to the General Manager DACH.
The position will be the primary contact for those markets providing the highest quality of legal and compliance services on a strategic as well as operational level.
Responsibilities of the Associate Director Legal & Compliance DACH include:
- Provide strategic legal & regulatory counsel to businesses across Germany, Switzerland and Austria on commercial, corporate and regulatory matters
- Manage the drafting, review, negotiation, execution of a wide variety of agreements, including drug distribution agreements, co-promotional agreements and any other commercial agreements within these markets
- Facilitate and manage the appropriate use of outside counsel
- Providing pragmatic and timely legal support on diverse local and international legal, compliance, transactional and commercial issues
- Run a solid governance framework as required by the country legislation
- Ensure compliance with local regulations, including data protection (GDPR), Anti- Bribery, competition law and other relevant frameworks
- Conduct regular Compliance Training to the respective affiliates
- Perform Compliance Monitoring within the respective region and beyond, where determined by the Head of Legal and Compliance Europe and Canada
- Review Interactions with Health Care Professionals (HCPs), Government Officials and Patient Advocacy Groups as well as marketing & medical material where Compliance /Legal input is required
- Where possible, act as the Information Officer (DE, AT) and Advertising Responsible Person (CH)
- Support the Transparency reporting to the extent required in the respective affiliates.
Idorsia Control Environment
- Ensure conducting business in compliance with all applicable laws, internal directives as well as in accordance with the data privacy laws
- Perform risk assessments and develop mitigation plans necessary to protect company assets
- Provide day-to-day advice and counsel on all health law and compliance-related issues
- Support Internal Audit on request of the International Legal Team in Headquarters
- Investigate potential instances of non-compliance in coordination with the Head of Legal and Compliance Europe and Canada.
- Foster the further development of the Idorsia Compliance as well as Legal Program
Requirements
- Law degree from a recognized European university – with a focus on German, Swiss and/or Austrian law
- Compliance certificate and/or strong experience in Compliance
- Minimum of 5 years experience in the life science industry or law firm advising pharmaceutical, biotechnology or medical device businesses
- Demonstrated experience in German, Swiss and Austrian legal systems
- Working knowledge in broader EU Compliance regimes
- Excellent understanding of the pharmaceutical industry practices that comes with a solid business acumen
- Sound general knowledge of commercial legal aspects and of laws and regulations governing biopharmaceutical companies on a wider European level
- Strong negotiation and diplomacy skills as well as excellent oral and written communication skills, suitable for all levels of the organization
- Strong interpersonal skills, cultural sensitivity, and ability to operate effectively across multiple jurisdictions
- Enthusiastic, results-oriented displaying intellectual curiosity
- Team-player with ability to set priorities and manage a wide-ranging work under a time-pressure
- Entrepreneurial, enjoys working in a fast-paced, fluid, small-company environment
- Strong ability to determine the significance of legal issues in the context of business objectives
- Proactive business-minded lawyer with strong capability and motivation to develop problem solving strategies and execute on them.
- Fluent in German and English.
